Green Heart Lawn Care

Terms & Conditions

  1. About these terms

These terms explain how GreenHeart Lawn Care provides services to you, how the contract works, and what happens if something goes wrong.
References to “lawns” include hard surfaces where relevant.

  1. Who we are and how to contact us

We are Greenheart Trading Ltd, trading as GreenHeart Lawn Care.

You can contact us by telephone, email, or via the contact page on our website.
Postal address: Greenheart Trading Ltd, Larcombe Farmhouse, Diptford, Totnes, TQ9 7PD.

We will contact you using the details you provide.

  1. When a contract starts

A contract begins when you accept a written quotation or order confirmation, whether or not signed. Acceptance may follow a site visit and discussion of treatment options.

If we cannot accept your order, we will inform you and no charge will be made.

  1. Our services and results

We provide lawn and hard surface treatments as described in your quotation and on our website.

You are paying for treatment processes and professional time, not guaranteed outcomes. We will carry out services with reasonable care and skill in line with industry standards. Lawn treatment results depend on factors outside our control, including weather, soil conditions, lawn usage, pests, disease, mowing frequency, and leaf clearance. Your statutory rights are not affected.

  1. Treatment programmes and visits

Annual Lawn Treatment Programmes include fertiliser applications and the control of weeds and moss.

These programmes operate on a treatment-based basis, not a fixed number of visits. Visits are scheduled to deliver the agreed treatments over the year.

In exceptional circumstances, including prolonged adverse weather or operational constraints, the number of visits in a year may reduce. All planned treatments will still be delivered, and the overall programme price will remain unchanged.

  1. Scheduling, access, and missed visits

We will notify you of planned treatment dates. Dates are approximate and may change due to weather or operational requirements.

If access has been agreed, treatments will be carried out even if you are not present. A “visit has taken place” card will be left.

If our proposed date is inconvenient, you must notify us in advance so we can reschedule.  Rescheduled visits will be re-notified to you by email and usually take place within 2-3 weeks.  If they cannot be rescheduled due to weather or lack of time before thew next treatment period starts then the treatments will be added to the next scheduled seasonal visit and treatments.  The original pricing will still apply.

Missed visits and access issues

If we attend as scheduled and are unable to access your lawn for any reason (including locked gates, obstructions, unsafe conditions, or heavy leaf cover), this will be treated as a missed visit.

In these circumstances:

  • The treatment will be rescheduled within the same treatment period or added to the next seasonal visit.  The original prices will apply.

This charge does not affect your entitlement to receive the treatment as part of your programme.

We are not responsible for delays caused by weather or other events outside our reasonable control but we will always endeavour to ensure customers receive all the treatments included in the programme.

  1. Your responsibilities

Before each visit, you must:

  • Ensure safe and reasonable access to all treatment areas
  • Remove dog waste, toys, furniture, and other obstacles
  • Keep lawns reasonably free of leaves

Leaf clearing is not included in our service. Failure to meet these requirements may prevent treatment from being carried out safely.

  1. Robot mowers and hidden items

Where mechanical work is carried out and a robot mower is installed, we will take reasonable care around perimeter wires only where an accurate map has been provided in advance. We do not accept liability for damage to robot mower infrastructure.

We are not responsible for damage to hidden objects, utilities, pipes, cables, or services unless their precise location has been provided to us in writing in advance and we have confirmed acceptance of the risk.

  1. Changes to services or prices

We may make changes to services to comply with legal or regulatory requirements.

Customers will be informed in advance of any price increases or changes to monthly payments.

  1. Cancelling the contract

Annual Lawn Treatment Programmes

You may cancel your programme at any time in writing or by contacting our office.

If you cancel after services have started:

  • You must pay for services already provided; and
  • We will calculate whether a refund or balancing payment is due.

If you cancel within five days of a scheduled visit, a visit charge may apply to reflect staffing, scheduling, and travel costs incurred.

Other services, including mechanical work

For non treatment programme services and contracts such as lawn renovations, you may have a legal right to cancel within 14 days, unless the service has been completed.

Mechanical services cancelled within four weeks of the scheduled date are subject to a cancellation charge of 50% of the service price or £250, whichever is lower, reflecting preparation and reserved resources.

Payment for lawn renovation services is due within 14 days of the completion of the work.  We state that the contract is completed on the day new grass seed is sown in the ground unless otherwise stated.

  1. When we may end the contract

We may end the contract if:

  • Payment remains outstanding more than 14 days after becoming due; or
  • You repeatedly fail to provide reasonable access for scheduled services.

In these circumstances, we may retain payments already made to cover costs reasonably incurred and seek to recover any payments due but not made..

  1. Prices and payment

Prices are shown on your quotation or order confirmation and include VAT where applicable.

Payment is due within 14 days of invoice, unless otherwise agreed. We accept Direct Debit, card payments, bank transfer, and cheques.

Late payments may be charged interest at 6% per annum above the base lending rate of a major UK clearing bank.

  1. Problems and complaints

If you have a problem with our service, please contact us as soon as possible so we can address it.

We are legally required to carry out services with reasonable care and skill. Nothing in these terms limits your statutory rights.

  1. Liability

We are responsible for foreseeable loss or damage caused by our failure to exercise reasonable care and skill.

We do not accept liability for treatment failure caused by factors outside our control, including weather, soil conditions, lawn usage, pests, disease, or inadequate mowing or leaf clearance.

Nothing in these terms limits liability where it would be unlawful to do so, including for death or personal injury caused by negligence.

  1. Personal information and photographs

We use personal information to provide services, process payments, and (where consent has been given) provide information about similar services.

We may take photographs of lawns for record-keeping and treatment planning. Photographs used for marketing purposes will not identify customers or addresses. You may opt out of marketing use at any time by informing us.

  1. Other important terms

We may transfer this agreement to another lawn care provider, provided there is no reduction in service quality or customer rights.

No third party has rights under this contract.

If any part of these terms is found unenforceable, the remaining terms will continue to apply.

These terms are governed by English law, and disputes are subject to the jurisdiction of the English courts.
